Disturbing injustices in Southern Africa

Nobody in south Africa is really and truly free until Clive Derby Lewis is Free together with Janus Waluz these two men were jailed for political crimes while Mandela and De Klerk received Nobel prizes for Peace and Tutu ran a TRC (Truth and Reconciliation commission ) when many were released yet ANC still hounds the likes of Eugene De Kok and we all ,as a society , generally, hope for real Reconciliation .

CLIVE DERBY-LEWIS NEWS

Clive Derby-Lewis was recommended for parole in July 2008, for possible release on 15 October 2008. The Department of Correctional Services (DCS) did absolutely nothing to execute the Parole Board’s recommendation, so the family instituted legal action against DCS to move ahead on their own Parole Board’s recommendation.

The case of course ended up in court where we lost against Advocate George Bizos, twelve senior advocates and various attorneys, representing DCS and Mrs. Hani
whose input was suddenly necessary to the processing of the parole. Attorneys Marius Coertze and his wife Elsabe Juin acted on our behalf, and retained advocates to present our case. The advocates were told that the Derby-Lewis family had no money for their fees but that funds would be raised from sympathetic members of the public and friends to try and cover the legal expenses.

Marius Coertze and Elsabe Juin have acted for Clive Derby-Lewis without ever sending us an account. We have paid them nothing, even though we want to. Our funds have been exhausted over the years due to legal expenses incurred during the trial in 1993, various appeals and the TRC’s amnesty proceedings in 1997/1998. During this time we have received financial support from the public and friends for which we will be forever grateful.

On 3 September 2010 Clive damaged his leg on a bed frame lying around in one of the passages in the Pretoria Central Prison. He asked to see a doctor but was only able to see the doctor – a Dr. Sebotsane – ten days later, and because of this delay, infection and eventually gangrene had set in to his leg. The doctor didn’t appear to see this danger, and simply prescribed cream for the leg. However, at Clive’s request, the doctor instructed that an X-Ray be taken of the leg, which instruction was ignored.

On Sunday 19 September during a visit, I saw his leg was swollen and black, and was oozing a horrible discharge, and knew that something urgent would have to be done. Marius Coertze obtained an urgent court order on Monday 20 September to admit Clive to hospital with immediate effect, and Monday afternoon, Dr. M.C. Durand examined Clive and declared his leg to be gangrenous. Dr. Durand immediately scheduled an operation for the following day. As well, Dr. Durand saw that a sore on Clive’s temple was cancerous. Clive had had this sore for some years and had asked Dr. Sebotsane about it, only to be given cream to apply to the sore.

Elsabe Juin’s report on what has happened as a result of the urgent court order is now sent to you as well. Without Marius Coertze and Elsabe Juin, Clive would probably have died in prison, as we cannot afford legal fees, having been wiped out over the years fighting in the courts foe justice for Clive.

Marius and Elsabe are now in danger of losing their practice because two of the advocates we retained in 2008 , Mr. Herman Barnardt and Mr. Danie van Loggerenberg, have now issued summary judgement against Marius and Elsabe and if R160 000 cannot be paid before the end of October, these two good people will lose their practice and thus their livelihood.

It cannot be that these two good people who have given legal service to Clive over the years and haven’t asked for one penny from him, must now be the victims of two advocates who knew we would have to raise money from the public, but who will now not wait and who will see Marius and Elsabe ruined for the sum of R160 000.
I am thus asking for your help in trying to raise this money to pay these advocates so that they will not put the Marius Coertze practice at risk.

Please help as these people have saved Clive’s life. Without the urgent court order against DCS, Clive’s leg would have worsened and he would probably have lost it, and the cancer would have become worse. Clive’s blood tests also show the appearance of prostate cancer and a urologist must be brought in to examine Clive. Clive will have to undergo further operations this coming Tuesday on his face and his leg, and there is talk that skin grafts may be necessary. In addition, the doctors have put him on stronger anti-biotic treatment as the poison in his leg was moving up above his knee towards the groin.

REPORT ON THE CONDITION

OF

CLIVE DERBY LEWIS

Clive Derby-Lewis still cannot be released from a Pretoria Hospital despite the intense struggles of six doctors’ attempts to improve his deteriorating medical condition.

GANGRENE

Clive was admitted to a private hospital in Pretoria on the 20th September as a result of a distressingly acute condition of gangrene in his right lower leg.

He was operated on during Tuesday 21st September for this condition and dead tissue measuring 8 cm x 6 cm (almost as big as a man’s fist) was removed from his right leg. Thereafter he was given an intravenous antibiotic to try and stop the spread of the gangrene.

The wound has been left open to drain and the wound covers are replaced regularly to keep the wound sterile.

The right leg is still swollen and his first antibiotic course has now finished. This is an indication that the fight against the gangrene has not been won. Mr Derby–Lewis is now on a second and much stronger course of antibiotics to try and stop the gangrene infection.

It should be noted that he was eventually admitted to hospital in a seriously neglected and abused condition from the South African Department of Correctional Services (DCS) Pretoria Central Prison. Doctors are still not sure that his right leg can be saved. Should the gangrene not heal then this leg will have to be amputated to combat the current rapidly spreading gangrene to the rest of his body.

HIGH BLOOD PRESSURE

During the initial clinical examination of Mr Derby-Lewis after his first admittance to hospital, doctors discovered that that his blood presure was a life-threathening 172/140. The doctors have given him medication to bring his blood pressure level under control.

We have been advised by the doctors that Clive’s blood pressure level is currently under control. However, these same doctors have also advised that the blood pressure will most probably become unstable once Clive returns to the prison where the proper medical treatment he is currently receiving in hospital is not available.

CANCER

On admittance to hospital the doctor discovered skin cancer on Clive’s right forehead. The cancer has spread from his hair line on his right temple to his eyebrow and covers an area of approximately 5 cm x 5 cm. Surgeon Dr. M.C. Du Rand, informed Clive that skin cancer takes a long time to become this large and that it has presented been obvious) over a period of two years or longer. The cancer is now so deep that it bleeds spontaneously. Biopsies so far have indicated that this cancer is an aggressive skin cancer which should be treated immediately.

Further blood tests conducted by the hospital indicate that Clive may also have prostate cancer. A urologist will be consulted to confirm this diagnosis.

TREATMENT

Dr. Du Rand informed Clive that his medical condition and state of health is as a result of gross negligence and mishandling on the part of DCS. Dr. du Rand is of the opinion that any medical practitioner could have diagnosed the various illnessess that Clive now has without any effort.

Mr. Marius Coertze, Clive’s Attorney, mentioned that the DCS hierarchy were obviously aware of his chronic and acute medical condition but have probably kept silent on this matter and have neglected it in the hope that Clive will die a so called natural death within the prison. within the next 12 months. The neglect of Clive by DCS could then easily be swept under the carpet.

ABUSE

According to Mr. Marius Coertze, the shocking neglect of Clive Derby-Lewis a 74 year old man by DCS continues even at the hospital where he is currently being treated! During the surgical operation on his right leg two DCS prison wardens who were guarding Clive insisted on being present within the operating theater whilst the operation was carried out.

This obstructed the work of the doctors and it was only after Mr. Marius Coertze, Clive’s attorney, threatend to have these prison wardens prosecuted for contempt of court that they actually agreed to wait outside the operating theater. They then watched the operation through a window.

The doctors objected strongly to the incident in the operating theater. It hampered the work of the surgeon and doctors involved in the operation and it also caused a further risk of infection and the spread of germs within the operating theater. Theater. As a rule no person other than the medical theater personnel is allowed within an operating theater during surgery.

The prison wardens have chained Clive Derby-Lewis to his bed. He cannot get up at will and do regular walks and exercise which is important for a patient’s post operative situation as regular movement assists in combating bloodclots.

Bloodclots can now form and create thrombosis in the leg and/or heart and/or an embolism in the lungs. To combat this trauma and even death, Clive is now being treated with blood thinning medication. (Clive can only walk about in his small room – he is not allowed into the hall outside his room).

Doctors have been forced to take this corrective action as a result of the fact that a 74 year old man with a bad leg has been chained to his bed.

Docters were shocked that DCS personnel unashamedly and openly have tried and continue to try to hamper his health by preventing doctors from treating Mr. Derby-Lewis, acting contrary to the court order allowing the medical profession to carry out its work. One of the prison wardens even prevented Dr. Du Rand examining Clive on the 24th September as he did not recognise the doctor and did not know if he was allowed to enter the room.

According to Mr. Marius Coertze the latest incident is DCS’s attitude towards visits by Clive’s wife Gaye. She has been allowed to visit him once. Each time she wants to visit she has to go to the Pretoria Central Prison and wait some time to get a permit which allows her one visit only, for 45 minutes.

The next day she must go back to the Pretoria Prison, aa long way from the hospital, to obtain a new written permission to visit Clive. The Pretoria Prison administration closed for the public holiday Friday 24 September resulting in a long weekend so nobody could visit Clive.DCS also gave Clive forms to be completed. According to Clive these forms are for him to be totally responsible for all the costs of compensating the wardens guarding him. Mr. Coertze his attorney could not advise him on the legal implications of this form as he was refused a visit to Clive.
